1. About Us

Rarediagnostics.eu is operated by Masdiag Sp. z o.o., a registered medical laboratory (KIDL number 3241) based at ul. Żeromskiego 33, 01-882 Warsaw, Poland, operating under Polish and EU healthcare regulations.

By accessing or using this website, placing an order, or otherwise using our services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Services.

2. Nature of Our Services

Rarediagnostics.eu sells dried blood spot (DBS) diagnostic test kits for rare inherited metabolic conditions. When you place an order, we ship you a collection kit; you collect a sample at home and send it to our laboratory in Warsaw for analysis.

Important: the diagnostic services offered on this website are in vitro diagnostic tests intended to provide quantitative information on specific biochemical biomarkers. All results should be interpreted by a qualified healthcare professional. These services do not replace medical consultation, diagnosis, or treatment. A positive, negative, or borderline result does not constitute a medical diagnosis.

3. Eligibility

By using the Services, you confirm that:

  • You are at least 18 years old, or are ordering on behalf of a minor as their parent or legal guardian;
  • You are purchasing for yourself, for a person in your care, or on behalf of a healthcare professional or institution;
  • The information you provide during checkout is accurate and complete.

4. Orders and Payment

  • All prices are displayed in Euro (EUR) and include any applicable charges unless stated otherwise.
  • Payment is processed at the time of order through our secure payment providers.
  • We reserve the right to refuse or cancel an order at our discretion, including in cases of suspected fraud, pricing errors, or unavailability of a test.
  • An order confirmation does not constitute acceptance of your order; a contract is formed once we dispatch your test kit.

5. Shipping and Delivery

  • We currently ship test kits to addresses within the European Union only.
  • Estimated delivery times are provided at checkout and are not guaranteed; delays may occur due to postal or customs factors beyond our control.
  • It is your responsibility to ensure the delivery address provided is accurate and accessible.

6. Returns, Withdrawal and Refunds

This section summarises our returns policy. The full policy, including detailed instructions, is available on our Returns Policy page, which forms part of these Terms.

  • Unopened kits: you may withdraw from your purchase within 14 calendar days of receipt, provided the kit remains sealed and unopened, in accordance with the EU Consumer Rights Directive (2011/83/EU).
  • Opened kits: in accordance with Article 16(e) of the EU Consumer Rights Directive, the right of withdrawal does not apply once a collection kit has been opened, due to hygiene and biological safety reasons. This applies regardless of whether a sample was collected.
  • Faulty or damaged kits: you are always entitled to a free replacement or full refund, regardless of whether the kit has been opened.
  • Diagnostic services: once a sample has been received and processed by our laboratory, the service performed cannot be refunded.

By placing an order, you acknowledge and accept these conditions. You will be asked to confirm this explicitly during checkout.

7. Sample Collection and Registration

Collecting a sample and registering it correctly is your responsibility. Detailed collection instructions are included with every kit and are also available on our DBS Method page.

Sample registration and any health-related information associated with your sample are collected through a separate, dedicated registration platform, which has its own privacy policy. This website (rarediagnostics.eu) is used solely for placing orders and does not collect health-related data.

We are not responsible for delays, inconclusive results, or an inability to process a sample resulting from incorrect collection, insufficient sample volume, damage during transit caused by factors outside our reasonable control, or failure to complete sample registration correctly.

8. Intellectual Property

All content on this website — including text, graphics, logos, and images — is the property of Masdiag Sp. z o.o. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Our liability arising from your use of the Services is limited to the amount you paid for the relevant order.
  • We are not liable for indirect, incidental, or consequential damages arising from your use of the Services.
  • Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or liability arising from the healthcare regulations under which we operate.

10. Governing Law and Disputes

These Terms are governed by the laws of Poland, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence as an EU consumer.

If you are a consumer resident in the EU, you may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes to our practices or for operational, legal, or regulatory reasons. The updated version will be posted on this page with a revised "Last updated" date.
